Renunciation of inheritance (South Korea)

⚖️ Law By CampusDown Wiki Editorial Team Last updated
Renunciation of inheritance is a family-court filing in which an heir declines both the assets and the debts of the deceased. The heir is then treated as never having been an heir at all.

Background

Inheritance in Korea is universal succession: heirs take on debts as well as assets. Since Roman law, civil-law systems have offered renunciation and limited acceptance so heirs needn't absorb unwanted debt, and Korea's Civil Act (in force since 1960) adopted both. In 1998 the Constitutional Court held it unconstitutional that heirs who didn't know about large debts were deemed to accept once three months passed. A 2002 amendment added "special qualified acceptance" for those cases. A 2022 amendment lets heirs who inherited as minors seek qualified acceptance after reaching adulthood.

Procedure and effect

File with the family court for the deceased's last address within three months of learning of the inheritance. Required documents include family-relation and basic certificates, the deceased's deregistered resident record, and a seal certificate. You can file online. Once accepted, the renunciation applies retroactively, so you're treated as never having been an heir. Disposing of or hiding estate assets beforehand, such as withdrawing deposits or selling a car, counts as outright acceptance and can void the renunciation. Life insurance payable to a named beneficiary isn't part of the estate and can still be received.

Next-in-line heirs and qualified acceptance

If all first-rank heirs (children) renounce, the debt passes to grandchildren and then to parents or siblings, the next-ranked statutory heirs. The whole family may have to file. A common workaround is for one first-rank heir to choose qualified acceptance while the others renounce. Qualified acceptance means paying debts only up to the value of inherited assets, which is useful when the balance is unclear. If you miss the deadline and receive a creditor's payment order, object within the two-week window.

FAQ

Can I still receive life insurance after renouncing?
Yes, if you are the named beneficiary, the payout is your own property.
What if three months have passed?
If you didn't know, without gross negligence, that debts exceeded assets, you can seek special qualified acceptance within three months of finding out.
