Overview

Article 9 of Korea’s Criminal Act states that acts of persons under 14 are not punished. Article 4(1)(2) of the Juvenile Act defines children aged 10 to under 14 who violate criminal law as *chokbeop sonyeon*; their cases go to the juvenile division of the family court, which may order one of ten protective dispositions (Art. 32), from guardian supervision and probation to short-term (≤6 months) or long-term (≤2 years, age 12+) reformatory commitment. Offenders aged 14–18 may be punished or given dispositions. Proposals to lower the age cap are debated against education and restorative approaches.
